Dawnspace Terms of Service
Welcome to Dawnspace, operated by Dawnspace Interactive. These Terms of Service ("Terms") govern your use of the Dawnspace website and all content, services, and products provided by Dawnspace Interactive. By accessing or using Dawnspace, you agree to be bound by these Terms. If you do not agree with any part of these Terms, then you may not use Dawnspace.
Acceptance of Terms
By accessing or using Dawnspace, you agree to be bound by these Terms and all applicable laws and regulations. If you do not agree with any of these Terms, you are prohibited from using or accessing Dawnspace. Dawnspace Interactive reserves the right to update or modify these Terms at any time without prior notice. Your continued use of Dawnspace following any such changes constitutes acceptance of the revised Terms.
User Content
Users may contribute content to Dawnspace, including but not limited to text, images, audio, video, and other materials ("User Content"). By submitting User Content, you grant Dawnspace Interactive a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with Dawnspace. You represent and warrant that you have all necessary rights to grant this license.
Copyright Policy
Dawnspace Interactive respects the intellectual property rights of others and expects users to do the same. Users are solely responsible for ensuring that their User Content does not infringe upon the copyrights, trademarks, or other intellectual property rights of third parties. Dawnspace Interactive will promptly remove any infringing User Content upon proper notification.
Data Privacy
Dawnspace Interactive is committed to protecting your privacy. We will never sell, rent, or share your personal information with third parties without your consent. Our Privacy Policy governs the collection, use, and disclosure of your personal information. By using Dawnspace, you consent to the terms of our Privacy Policy.
Prohibited Conduct
You agree not to engage in any of the following prohibited activities:
- Violating any applicable laws or regulations.
- Uploading, posting, or transmitting any User Content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable on the public-facing areas of the website.
- Engaging in or supporting any form of racism, homophobia, transphobia, xenophobia, or discrimination in public forums or communications, including but not limited to on the homepage, forums, and public comment sections.
- Promoting violence, hate speech, or discriminatory acts in any public space.
- Uploading, posting, or transmitting any User Content that infringes upon the intellectual property rights of others.
- Impersonating any person or entity, or falsely stating or otherwise misrepresenting your affiliation with a person or entity.
Note: The above restrictions apply specifically to public spaces (such as homepage discussions, forums, and comments visible to all users). Users are permitted to express their opinions and beliefs within private spaces (such as group discussions or personal message boards) as long as these opinions do not directly target others in a harmful, abusive, or discriminatory manner.
- Groups and Private Spaces
Dawnspace acknowledges that users may wish to discuss or express opinions that may not align with the views held in public spaces. Therefore, the following guidelines apply to groups and private message boards:
- Groups are spaces where users can join and create communities based on shared interests, opinions, or other commonalities. These groups allow for more free-form expression, including the discussion of political, cultural, or controversial topics, as long as members adhere to the basic requirement of not targeting or harming others in a discriminatory or abusive manner.
- Private Message Boards: Users are allowed to express their views on their personal message boards. However, it is prohibited to use someone else's message board to directly target or attack them or other users.
- It is important to note that while expression is allowed in private spaces, Dawnspace encourages respectful dialogue and prohibits any content that could be harmful, discriminatory, or abusive towards other users in these areas as well.
These spaces are considered private in nature and may not reflect the official stance or policy of Dawnspace Interactive.
- Business Licenses
Dawnspace Interactive offers a Business License option for users who wish to use Dawnspace’s platform for commercial purposes. When users opt for a Business License, Dawnspace Interactive’s rights to the content are more limited compared to standard User Content licenses.
- Business Licenses: By selecting a Business License, users grant Dawnspace Interactive specific rights to use, reproduce, and display their content, but this license does not provide Dawnspace Interactive with full ownership over the content. The user retains primary ownership of the content, and Dawnspace Interactive is only allowed to use it in specific, business-related contexts, such as promotional or commercial use.
- The Business License is subject to a more restricted set of permissions than the general User Content terms, ensuring that the original creator of the content maintains control.
- Users who are interested in Business Licenses should read the Business Licensing Page for full details, including the scope of rights granted and the responsibilities involved.
Indemnification
You agree to indemnify, defend, and hold harmless Dawnspace Interactive, its officers, directors, employees, agents, licensors, and suppliers from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of these Terms or any activity related to your account.
Limitation of Liability
In no event shall Dawnspace Interactive or its suppliers be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, arising out of or in connection with your use of Dawnspace.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of England, without regard to its conflict of law provisions.
